Court Issues Warrant For Oluwo’s Arrest

A Magistrate Court, sitting in Osogbo, the Osun State capital, has issued a bench warrant against the Oluwo of Iwo, Oba Adewale Akanbi, following the monarch’s refusal to appear in court in a case instituted by the Oluwo of Iwo Oke, Oba Kadiri Adeoye.

The implication of the bench warrant, according to lawyers, is that the monarch should be arrested and brought before the court at its next adjourned sitting.

Although Oba Akanbi was represented in court on Tuesday by his counsel, Mr. Olaide Yekeen, Magistrate Olusola Aluko issued the bench warrant  despite the application for a stay of proceeding, notice of preliminary objection and a notice of appeal filed before the court.

Oba Akanbi, the paramount ruler of Iwoland, was dragged before the court by the Oluwo of Iwo Oke, for alleged criminal offences.

The magistrate had, at the last sitting of the court on December 2, threatened to issue a bench warrant on the monarch if he refused to appear in court on Tuesday (yesterday).

Counsel for Oba Akanbi had told the court that his client had several applications before the court, adding that the notice of preliminary objection, which bordered on competence and jurisdiction of the court, should be heard first before the substantive application.

He said Section 19 (1) of the Magistrate Court Laws highlighted the jurisdiction of the court, arguing that the court lacked jurisdiction to hear the matter.

“When there is an application challenging the jurisdiction of the court, such application should be taken first. We are vehemently and seriously challenging the competence and jurisdiction of this court and our applications should be taken first,” he said.

But counsel for the applicant, Soji Oyetayo, in his submission, told the court that the court made an order which the Oluwo had refused to comply with.

He stated that the applications, filed by the first respondent (the Oluwo) could not stop the order of the court that the monarch should appear before it.

“I urge the court to jettison the applications. They have to obey the earlier order of the court. The first respondent should be in court today but he is not in a flagrant disobedience of the court order,” he said.

The magistrate, in his ruling, agreed with the respondent (the Oluwo) on the issue of jurisdiction, but said the notice of appeal was not ripe.

He said, “The court mandated the first respondent to appear in court. He has violated the court order of the last adjourned date. I hereby issue a bench warrant against him.”

The counsel for Oluwo, while speaking with journalists on the court premises, said the applications for a stay of proceedings, notice of appeal and application on the jurisdiction of the court, ought to have been heard first before the magistrate issued the bench warrant.

Yekeen stated that the authorities he cited during the hearing should suffice, adding  that even in a case of contempt of court, the court should hear such objections first.

He argued that the order was made in error.

Yekeen added, “As it is, what we have is that we are following the due process of the law and we believe that the law should be and grow and it should be allowed to follow the due process.

“If a doctor makes a mistake, the mistake is buried six feet under the ground but if a lawyer or a judge makes a mistake, the mistake will be inherited by generations unborn.  That is what we have today.”

A pure drama took place recently in a Lagos community when a policeman tried to evade arrest by his colleagues.

The incident occurred at a United Bank of Africa (UBA) premises in Surulere on Thursday afternoon.

According to The Nation, the policeman had followed a customer to extort her at the bank but was caught pants down.

It was gathered that the policemen identified as Ogogor, who arrested a woman for alleged traffic offence had demanded N30,000 bribe from her, insisting that she would pay N50,000 should the matter get to the station.

He thereafter followed the woman who claimed to be out of cash to the bank in order for her to withdraw the N30,000 and give him, not knowing she had put a call across to a rights activist.

It was gathered that the unnamed activist contacted the Police Commissioner, Fatai Owoseni, who deployed policemen to the scene with an order to apprehend the errant personnel.

But on getting to the scene, it was learnt that Ogogor first went under a vehicle parked within the premises but was dragged out by his colleagues who had been directed to fetch him.

“He became violent. When he was dragged from underneath the vehicle. He started tearing his uniform and went n*ked in public. He striped to avoid being arrested but some area boys came to assist the policemen who came from the CP’s office to effect the arrest and they dragged him into the police van,” said a source.

It was gathered that Ogogor was taken to the X-Squad unit at the police command, where he was detained and would be tried in orderly room

President Buhari Opens Up On Arrested Judges

President Muhammadu Buhari has opened up on the reason for the arrest of Supreme Court justices and judges across the nation.

The Presidency said the on-going `surgical operation’ against some judicial officers is specifically targeted at corruption and not at the judiciary as an institution.

Malam Garba Shehu, the Senior Special Assistant on Media and Publicity to President Muhammadu Buhari, made the clarification in a statement in Abuja on Sunday.

According to Shehu, the president reserves his highest respect for the institution of the judiciary as the third arm of government and will not do anything to undermine its independence.

Shehu said Buhari remained a committed democrat, “in words and in his actions, and will not take any action in violation of the constitution.

“In a robust democracy, such as ours, there is bound to be a plurality of opinions on any given issue but there is a convergence of views that the country has a corruption problem that needs to be corrected.

“But reports by a section of the media are giving us cause for concern.’’

The Presidential aide advised that, in undertaking the task of reporting, the media should be careful about the fault lines they opened.

“It is wrong to present this incident as a confrontation between the executive and judicial arms of government,’’ he said

Shehu said the Presidency had received assurances from the Department of Security Services (DSS) that all due processes of the law, including the possession of search and arrest warrants, were obtained before the searches on some judges.

“To suggest that the government is acting outside the law in a dictatorial manner is to breach the interest of the state,’’ he said.

The arrest of three judges for alleged corruption has angered some stakeholders in the judiciary, especially Nigeria Bar Association (NBA).

The NBA has asked the president to order the release of the judges or face the consequences.

Police Getting Close To Arresting Kim’s Attackers

A tiny gemstone found outside the Paris apartments where Kim Kardashian was robbed could be a vital clue to catching her attackers by the police.

DNA tests on the dropped gemstone is hoped to identify the armed men who took off with the reality star’s jewellery believed to be worth around £8 million.

A source told the MailOnline.: ‘A piece of stolen jewellery was found close to the block, and was presumably dropped by the gang. It suggests that the criminals may have made mistakes because they were in such a hurry.’

This comes after the 35-year-old called in former special forces troops to lead the probe into the hotel raid. Kim has also filed a £4.5 million insurance claim for the items, including the £3.2 million engagement ring.
